FDA Defines Business Size Under the FSMA Preventive Controls Regulations

Under the Food and Drug Administration (FDA) Food Safety Modernization Act (FSMA), small businesses may be eligible for certain exemptions and later deadlines for compliance on the Preventive Controls for Human Food and Animal Food regulations. On March 19th, a new draft was released by the FDA to address common questions businesses may have when determining their true number of employees.

The draft defines key terms such as “full-time equivalent” and “subsidiary”, and provides a calculation method for determining the number of employees. It also provides examples of unclear situations businesses may run into and aims to clear up any confusion.
