On March 21, 2018, the Food and Drug Administration (FDA) released guidance on the Foreign Supplier Verification (FSVP) rule regarding the importation of live animals. Under this guidance, the FDA states that is does not intend to enforce the FSVP requirements in attempts to make the importation of some of these animals less taxing. Instead, it aims to exercise “enforcement discretion,” similar to exemptions in the FSVP rule given for certain USDA-regulated products.
