State laws impact how decisions are made by state and local education agencies with regard to school curricula and school-based services offered, including the content and delivery of sexual health education and may vary from general mandates to specific guidelines. As a result, state and local education agencies may have difficulty determining their jurisdiction’s landscape of requirements. To assist jurisdictions, CDC conducted an analysis of state laws and regulations touching health education and specifically, school-based sexual health education including HIV and STI prevention education. Laws were included in the analysis if they had at least one characteristic related to school-based curricula or classroom-based instruction on sexual health or HIV and STD prevention. Forty-four states and the District of Columbia were identified to have at least one law that addressed these topics.
